What is a Notary Public?

A Notary Public is a State appointed impartial public servant who legally stamps an important document to deter fraudulent activity when being signed. The stamp verifies that they appeared before a notary public with identification and either acknowledges or takes an oath. These official acts are called notarizations, or notarial acts.   • The purpose of an acknowledgment is for a signer, whose identity has been verified, to declare to a Notary or notarial officer that he or she has willingly signed a document.

  • The purpose of a jurat—also known in some states as a “verification upon oath or affirmation”—is for a signer to swear to or affirm the truthfulness of the contents of a document to a Notary or notarial officer.

  • Most documents have the appropriate wording pre-printed on the document called the notary certificate. However, if you create your own document it may not bear this information. This is when you will have to choose which document to use. It is unlawful for a notary to advise in NYS which document to use, but you may ask the party receiving the document which they need or you can seek a lawyer for legal advice. Both documents are valid notarizations.
